Copyright & DMCA Policy

Skyera respects the intellectual-property rights of others and expects users of ToolsforWriting.com to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and other applicable law, including by removing or disabling access to the allegedly infringing material and, in appropriate circumstances, terminating the accounts of repeat infringers.

This Policy applies to user-submitted content on the Service. It does not apply to third-party websites linked from the Service, or to outputs that you generate locally in your browser and never submit to us. Skyera's own software, designs, and copy are protected by intellectual-property laws and may not be copied without our permission.

Send written notices of alleged copyright infringement to our designated agent:

To be effective, your notice must include all of the following:

1. A physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works;
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with sufficient detail to allow us to locate it (e.g., the URL on the Service);
4. Sufficient information to allow us to contact you, such as an address, telephone number, and email address;
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys' fees, incurred by us, by the alleged infringer, or by the copyright owner's licensee, who is injured by our reliance on the misrepresentation in removing or disabling access to the material.

If material you submitted to the Service was removed or disabled following a DMCA notice, you may file a counter-notice if you believe the material was removed as a result of mistake or misidentification.

To be effective, your counter-notice must include all of the following:

1. Your physical or electronic signature;
2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled;
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if your address is outside the United States, the courts of United Arab Emirates), and that you will accept service of process from the person who provided the original notice or an agent of that person.

On receipt of a valid counter-notice we will forward it to the complaining party. If the complaining party does not notify us within 10 to 14 business days that they have filed an action seeking a court order to restrain you from engaging in the alleged infringing activity, we may restore the material.

In accordance with the DMCA and other applicable law, we have a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are repeat infringers. We may also limit access to the Service or terminate accounts of any user who infringes the intellectual-property rights of others, regardless of whether there is any repeat infringement.

If you believe that material on the Service infringes a trademark you own, send a written notice to support@toolsforwriting.com that includes (a) identification of the trademark and the registration if applicable, (b) the URL or other location of the allegedly infringing material, (c) your contact information, (d) a statement that you have a good-faith belief that the use is not authorized, and (e) a statement that the information is accurate and that you are the rights holder or authorized to act on their behalf.
